1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Customer"), and Digital Wealth Protocol, operated by Be Proud Global ("we," "us," or "our"), concerning your access to and use of the www.digitalwealthprotocol.com website (the "Site") and any products, programs, content, or services offered through it (collectively, the "Products").
By accessing the Site, purchasing a Product, or clicking any "I agree," "Buy Now," or equivalent button at checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Refund Policy, and our Privacy Policy. If you do not agree, do not use the Site or purchase any Product.
2. ELIGIBILITY
By using the Site or purchasing a Product, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. Products are intended for adult buyers operating or intending to operate a business.
3. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and all Products are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, training materials, templates, workflows, and documentation (collectively, the "Content"), together with all trademarks, service marks, and logos (the "Marks"), are owned or controlled by us or licensed to us, and are protected by copyright, trademark, and other intellectual property laws of Thailand and international jurisdictions.
4. LICENSE TO USE PURCHASED PRODUCTS
Upon successful payment, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the purchased Product for your own personal and business use.
You agree that you will not:
Copy, reproduce, distribute, resell, sublicense, or publicly share any part of the Product;
Share your login credentials or grant access to the Product to any third party;
Use the Product to create a competing or derivative product;
Reverse engineer, modify, or create derivative works from the Product;
Remove, alter, or obscure any copyright, trademark, or proprietary notices.
Violation of this license constitutes a material breach of these Terms and results in immediate termination of your access without refund, in addition to any legal remedies available to us.
5. PURCHASE TERMS AND DIGITAL DELIVERY
All Products are digital goods delivered electronically. By completing your purchase, you expressly acknowledge and agree that:
Delivery begins immediately upon successful payment, either by instant access, account provisioning, or email delivery;
You expressly consent to the commencement of delivery of digital content immediately after purchase and you expressly waive any statutory right of withdrawal, cooling-off period, or cancellation right that would otherwise apply under consumer protection law in your jurisdiction (including, where applicable, EU Directive 2011/83/EU and UK Consumer Contracts Regulations 2013), to the fullest extent permitted by law, and you agree that the refund protections set out in our Refund Policy apply in their place;
Order bumps, upsells, and upgrades presented during checkout are optional, clearly disclosed, and priced separately. Your decision to add these items to your order is your own, and each item is subject to these Terms;
All prices are in US Dollars (USD) unless otherwise stated and are exclusive of any taxes that may apply in your jurisdiction.
6. REFUNDS
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary, we offer a two-tier refund guarantee:
A 30-day no-questions-asked refund window from your date of purchase; and
A 31–180 day action-based guarantee that requires documented proof of good-faith application of the methods taught in the Product.

7. CHARGEBACKS AND PAYMENT DISPUTES
By completing your purchase, you agree that initiating a chargeback, payment dispute, or reversal with your bank, card issuer, or payment provider before contacting us at [email protected] and completing the refund process set out in our Refund Policy constitutes a material breach of these Terms and forfeits your eligibility for refund under this agreement.
We reserve the right to contest any chargeback filed in violation of this clause and to submit these Terms, your checkout acceptance timestamp, delivery records, and all relevant account activity to your card network as evidence. Fraudulent chargebacks may be reported to the relevant authorities and chargeback-abuse databases.
8. USER REPRESENTATIONS AND PROHIBITED USES
By using the Site or Products, you represent and warrant that:
All information you submit is true, accurate, current, and complete, and you will maintain its accuracy;
You will not use the Site or Products for any unlawful purpose;
You will not attempt to bypass any security or access control measures;
You will not use the Site or Products to harass, defame, or harm any person;
You will not use automated scripts, bots, or scrapers on the Site;
You will not engage in any activity that interferes with or disrupts the Site.
We reserve the right to suspend or terminate your access, without refund, for any violation.
9. DISCLAIMER
The information, training, and Products provided by Digital Wealth Protocol are for educational and informational purposes only. Results vary and are not guaranteed. Any earnings or income representations made by us, our affiliates, or our customers are aspirational statements only and do not guarantee any particular outcome.
Your results will depend on many factors, including but not limited to your effort, experience, market conditions, and implementation. We make no guarantees, express or implied, regarding the success, profitability, or financial outcomes you may experience.
THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, in no event shall Digital Wealth Protocol, Be Proud Global, its owners, employees, affiliates, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site or Products.
Our total aggregate liability to you for any and all claims arising out of or relating to these Terms, the Site, or any Product shall not exceed the total amount you paid to us for the Product giving rise to the claim in the twelve (12) months preceding the claim.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Digital Wealth Protocol, Be Proud Global, and our respective owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Site or Products; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable law or regulation.
12. THIRD-PARTY SERVICES
The Site and Products may integrate with or link to third-party services, platforms, and tools (including but not limited to payment processors, email providers, and software platforms such as GoHighLevel). We do not control and are not responsible for the availability, content, policies, or practices of any third-party service. Your use of any third-party service is at your own risk and subject to that third party's terms.
13. PRIVACY
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection, use, and processing of your information as described in the Privacy Policy.
14. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. The "Last Updated" date at the top of this page will reflect the most recent revision. Material changes will be communicated via email or a prominent notice on the Site. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
15. TERMINATION
We reserve the right, in our sole discretion, to suspend or terminate your access to the Site or any Product, with or without notice, for any conduct that we believe violates these Terms, is harmful to other users or third parties, or is otherwise contrary to our interests. Termination for cause forfeits any right to refund.
16. GOVERNING LAW
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles.
17. DISPUTE RESOLUTION
Informal resolution first. Before filing any formal claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Jurisdiction. If informal resolution fails, any legal action, proceeding, or claim brought by either party shall be commenced and prosecuted exclusively in the competent courts of Chiang Mai, Thailand, and both parties hereby irrevocably consent to the exclusive jurisdiction of those courts and waive all defenses of lack of personal jurisdiction and forum non conveniens.
18. SEVERABILITY
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
19. WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
20. ASSIGNMENT
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice.
21. ENTIRE AGREEMENT
These Terms, together with our Refund Policy and Privacy Policy, constitute the entire agreement between you and us regarding the Site and Products, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
